Overview
Gluckstein Lawyers is excited to host our fourth annual Medical Malpractice Conference, Risky Business, taking place using a hybrid model, on November 29, 2022, from 9:00 AM to 4:00 PM, with a networking event starting at 4:00 PM.
The theme of this year’s conference is "Case Updates and Practical Tips."
Medical Negligence cases are challenging, complex and expensive to prosecute. Patients seeking damages against their medical care providers face more than the usual obstacles in a typical tort claim. Success in medical malpractice cases hinge on careful scrutiny of large volumes of records, often coming to thousands of pages, sorting through a tangled web of detail, and understand and analyzing difficult scientific concepts and theories. The lawyer needs to understand the medicine and develop a cogent theory of the case, both on standard of care and causation, before engaging with experts. This is the advocacy demanded of competent plaintiff’s counsel. Remember, the defence in medical malpractice cases will always be vigorous, with highly skilled and experience counsel on the other side.
Gluckstein Lawyer’s Risky Business conference aims to provide our attendees with tips and guidance on how to meet the challenges of medical malpractice litigation, thereby ensuring that you get your clients all they deserve.
We have assembled an impressive faculty to cover a broad range of important and practical topics. We are lucky to have Dr. Peter Rumney speaking about the needs of children with serious physical and cognitive limitations. Dr. Rumney’s talk will help us better understand our clients’ needs and help us do appropriate damages assessments. Dr. Barry Schifrin, from Los Angeles, will talk to us about a recurring problem in medical malpractice cases – junk science – and how to deal unreliable “science”. You will also hear about the difficult and often confusing law of causation, in the hope that we might bring some badly needed clarification to the subject. The Honourable Madam Justice Darla Wilson, will also address causation from a judicial perspective. You will hear about class actions, mass torts, medical device regulation and patient safety, and much more.
Finally, we will leave ample time for questions, with the opportunity to mingle with all attendees and presenters over a glass of wine following the conference.

As a bonus this year, our attendees will hear a lunchtime keynote address from Mike Shoreman, the “Unbalanced Paddleboarder” who will share his experiences overcoming adversity in the face of a devastating neurological disorder diagnosis and his quest to raise money and awareness for youth mental health supports by paddleboarding across the Great Lakes.

Charles
GlucksteinView BioCharles is the owner and managing partner of Gluckstein Lawyers and has guided the firm to become the leaders in Personal Injury in Canada. He succeeded his father Bernard who founded the practice in 1962. He has been endorsed by his peers as a leading personal injury lawyer in both Best Lawyers in Canada and Lexpert directories. Charles has been successful at trial in both jury and judge alone cases. In 2001, Charles was recognized as a Specialist in Civil Litigation. He frequently lectures at conferences for legal organizations, both locally as well as outside of Ontario on all topics of personal injury as well as the modernization of the profession using technology.

Richard
HalpernView BioRichard Halpern is a senior lawyer acting exclusively for injured people in medical negligence cases, with a special focus on infants injured at or around the time of birth. Richard is known across Canada for his expertise in birth injury cases. He has more than 30 years of experience representing seriously injured people.
Richard has a detailed understanding of the highly technical medical issues, particularly relating to birth injury cases. His experience allows him to provide meaningful advice and direction to families considering a medical negligence lawsuit following a review of the medical records.

Honourable Madam Justice
Darla WilsonMadam Justice Darla Wilson received a Bachelor of Arts from Queen’s University in 1981, and a Bachelor of Laws from Queen’s University in 1984. She was admitted to the Bar of Ontario in 1986. Madam Justice Wilson was previously a partner with Lawson McGrenere LLP in Toronto, where she practiced exclusively in the area of civil litigation. She carried on her practice throughout Ontario defending hospitals and other health care facilities on negligence claims, general insurance defence work including occupier’s liability, motor vehicle and municipal negligence claims as well as representing plaintiffs in personal injury claims. Madam Justice Wilson was an instructor in Trial Advocacy at the University of Toronto Law School, as well as a Director of the Advocates’ Society and a member of the Board of Directors of the Medico-Legal Society.
In December 2007, she was appointed to the Superior Court of Justice in Toronto. From 2015-2017 she was the Civil Team Leader for long trials in Toronto and she currently is co-team lead for the civil team in Toronto responsible for pretrials and trials. Madam Justice Wilson has been the team lead in Toronto for Rule 7 motions since 2015. She is a member of the Moot Court Council and Dean’s Council at Queen’s Law School and is currently on the Board of Directors of the Ontario Superior Court Judges Association. Justice Wilson is a judicial member of The Holland Group, comprised of advocates dedicated to promoting reforms in medical malpractice actions. Madam Justice Wilson is an avid long-distance runner and considers the Boston Marathon and the Berlin Marathon as her two favourite races.

Dr. Barry
SchifrinDr. Barry Schifrin, MD obtained his B.A. in 1959 from Columbia College and his M.D. in 1963 from Chicago Medical School. He has been on the faculties of Harvard, USC and Loma Linda Medical Schools in the Departments of Obstetrics and Gynecology. He is a Diplomate of the American Board of Obstetrics and Gynecology, having been certified in both Obstetrics & Gynecology and Maternal-Fetal Medicine. He is currently a consulting Obstetrician-Gynecologist at Kaiser Permanente, Los Angeles Medical Center, Los Angeles, California and Assistant Professor of Obstetrics and Gynecology at Keck School of Medicine, University of Southern California School, Los Angeles, California and formerly the Director of the OB/GYN Residency Program at Glendale Adventist Hospital in Glendale, California. Dr. Schifrin has been involved with fetal monitoring since its introduction into clinical practice. -
Paul
CahillPaul Cahill has been a Partner at Will Davidson LLP since 2011 having started his legal career there as an articling student in 2004. Paul practices in all areas of personal injury with a specific focus on medical malpractice. Paul’s advanced advocacy skills both inside and outside of the courtroom have led to him being recognized by the Law Society of Ontario as a Certified Specialist in Civil Litigation. Paul has proven his acumen for trial work through a number of successful trial outcomes over the years. This has led to him being recognized by his peers and numerous publications including Best Lawyers in Canada for Personal Injury Litigation (’21, ’22) & Medical Negligence (’22); and Lexpert. -
Brian
MoherBrian was called to the Ontario Bar in 2005 and has devoted his career to complex litigation. He has acted as Trial and Appellate counsel with experience at Superior Court of Justice, Divisional Court, Court of Appeal, and the Supreme Court of Canada, as well as being appointed Pro Hac Vice counsel in the United States.
Brian spent the first decade of his career as a health law defence lawyer in both civil and professional regulatory proceedings. In 2015, Brian started working as plaintiff’s counsel in medical negligence actions. Brian has practised as plaintiff class actions counsel since 2005. He acted as trial counsel in medical device class actions, including St. Jude Medical v Andersen and Taylor v Canada.

Jessica
GoloskyView BioJessica joined Gluckstein Lawyers as an articling student in 2017 and is a graduate of the J.D. program from the Faculty of Law at Western University. She graduated on the Dean’s Honour List and was awarded the Law Society of Ontario Prize for academic excellence.

BrunnerMonika Brunner is the Director of the National Health Team at Bayshore Health Care. She has been with Bayshore for the last 21 years and has worked exclusively with insurance companies across Canada, including Extended Health insurers, Auto insurers and Worker’s Compensation Boards.Monika is responsible for reviewing medical documents and reports and making recommendations based on those reports for the level and amount of care each client requires. With her wealth of experience, she can review medical reports and assessments and ascertain what tasks require the skill level of an RN, RPN, PSW or an RSW. -
James
NewlandJames specializes in individual personal injury cases, mass torts, and class actions, often involving defective medical devices, pharmaceuticals, or mass transit accidents. He has represented clients in numerous negotiations, mediations, and other forms of ADR, and has acted as a mediator since 1997. He has been on the Toronto roster for the Ontario Mandatory Mediation Program since its inception in 1999 and has conducted numerous mediations in the personal injury and insurance areas.
