FSCO just issued an update to the Minor Injury Guideline (MIG) effective November 1, 2011.

This update clarifies some issues related to payments for treatment provided under the MIG. Here are the highlights:

  • The collateral insurer remains the first source to look to for health care benefits, and these benefits must first be exhausted before an insured can look to the auto insurer. The change however is that FSCO has clarified the rules to say that the $3500.00 limit exists outside of whatever the collateral insurer has already paid. Therefore the insurer cannot attempt to reduce the $3500.00 limit by any treatment amounts received by the insured from their collateral benefit carrier.
  • FSCO has amended the rules regarding payments to health care practitioners to allow the insured to easily switch treatment providers.
  • The Guideline applies to all documents delivered after November 1, 2011 regardless of accident date.
